When determining child support, courts must adhere closely to the New York's child support guidelines. The first step in child support calculation is to determine each parent's gross income. Next, the court will then settle on the percentage of that income that must go to child support. Finally, the court will apportion a pro rata share of the child support to each parent.

There are certain instances when a court may deviate from the child support guidelines. We will make sure the court properly considers these guidelines when making your child support determination. Reasons to deviate from the guidelines include:

  • Noncustodial parental arrangements
  • Individuals with high incomes
  • Special needs of children

Child Support Modifications and Enforcement in New York

Child support requirements frequently change after a judge finalizes a divorce. We represent and defend parents interested in child support modification or involved in enforcement actions. If there has been a significant change in your circumstance, the court could modify their original order for support.

Child support will also increase automatically if the county is collecting child support. After a certain period, the county will approve a cost of living increase for child support. We will work to shield you from this payment increase.

Spousal Maintenance

Unlike child support, there is no statutory formula for determining spousal maintenance. When determining a plan for alimony, the court will consider a number of factors, including the length of your marriage, the incomes of both parties, future earning potential, age, and health. We will make sure the court properly considers your circumstances so your financial future is protected.
