Some Frequently Asked Questions About Petitioning for Guardianship

  • Who may obtain guardianship? Anyone with a direct legal or familial tie to the ward may seek guardianship. In New York, this includes the spouse, an adult child or sibling. The court may also appoint a professional guardian, in the event a family member cannot be found or does not seek guardianship.
  • Who might require a guardian? Any adult who can be shown to be incapacitated by a mental or physical medical condition might require a guardian. In addition, any minor-aged child under 18 can require a guardian, if the biological parents are no longer able to provide care.
  • How do you obtain guardianship? A family member or trustee of the ward is required to file a court petition to be appointed legal guardian. The petition process is complex and requires extensive medical, financial and legal records as evidence that guardianship is necessary. The petitioner will undergo a rigorous examination at a hearing to ensure the appointment is appropriate and to respond to any objections to the appointment. If the Court rules in the petitioner's favor, a Letter of Guardianship will be issued.
